(LOS ANGELES) In a sweeping decision by judges of the 6th Circuit court of appeals Wednesday slapped down Kim Davis' request for a stay of the lower court's ruling, mandating her to begin issuing licences in Rowan County starting Monday or be in danger of being held in contempt of court. The ruling from the 6th Circuit reads:
"injunction operates not against Davis personally, but against the holder of her office of Rowan County Clerk. In light of the binding holding of Obergefell, it cannot be defensibly argued that the holder of the Rowan County Clerk’s office, apart from who personally occupies that office, may decline to act in conformity with the United States Constitution as interpreted by a dispositive holding of the United States Supreme Court."
"There is thus little or no likelihood that the Clerk in her official capacity will prevail on appeal,"
This is a victory for the fight for Marriage Equality since this ruling will be referred to in regard to any dispute involving a public official denying marriage rights to a couple.
